Madhesh Province Chief Minister Saroj Kumar Yadav will no longer be able to make policy decisions that have long-term impact on the province. The Supreme Court has issued an interim order restricting him from taking such decisions until the related case is concluded.
On Wednesday, a single bench of Justice Tek Prasad Dhungana, considering the balance of convenience, instructed Chief Minister Yadav not to undertake any activities such as introducing long-term policies, programs, budgets, or structural changes in the name of the provincial government. The order came after a hearing on a writ petition filed by Rakiprasad Sah and others.
Yadav had been appointed Chief Minister last Sunday by Province Head Sumitra Subedi Bhandari under Article 168(3) of the Constitution, on the basis of being the leader of the largest party. However, various parties raised political and legal objections regarding his appointment.
The political temperature rose further after Yadav was administered the oath of office in a secret manner at Panas Hotel in Bardibas on Monday morning. Following widespread criticism of these actions, Province Head Bhandari was dismissed by President Ram Chandra Paudel on the recommendation of the Council of Ministers. Surendra Lal Karna has now assumed office as the new Province Head.
Until the final verdict on the writ petition, Chief Minister Yadav will remain limited to carrying out only routine administrative functions. The court’s order has further intensified the political sensitivity surrounding the ongoing dispute over the formation of the provincial government.
