Supreme Court Mandate: Investigation into Extrajudicial Killings in Madhesh Made Mandatory

The Supreme Court has issued a directive to the government to investigate extrajudicial killings that occurred in Madhesh. The full bench, comprising Justices Sapna Pradhan Malla, Kumar Regmi, and Hariprasad Phuyal, took this step.

Through this ruling, the Supreme Court has ordered an inquiry into the extrajudicial killings of over 400 citizens under the special security plan implemented by the then government led by Madhav Kumar Nepal.

Background

  • Filing of Petition: Advocate Dr. Sunil Ranjan Singh filed a petition in the Supreme Court in 2067 BS (2010–2011 AD), demanding investigation into more than 400 extrajudicial killings in Madhesh.

  • Special Security Plan: The then Cabinet decided to implement a special security plan on 14 Shrawan 2066 BS (1999 AD), which was executed during the tenure of then Home Minister Bhim Rawal.

  • International Reports: The United Nations Office of the High Commissioner in Nepal reported between 2064–2068 BS (2007–2012 AD) that 27 civilians had been killed extrajudicially in Madhesh. The National Human Rights Commission and other international bodies also highlighted that this security policy violated the fundamental rights of civilians.

According to Nirajan Pandey, the Information Officer of the Supreme Court, this mandate will ensure an impartial investigation into human rights violations caused by the security policy implemented in Madhesh.
